Privacy Policy

1. Overview and Scope

This Privacy Policy describes how SportsBug, LLC ("SportsBug," "we," "us," or "our") collects, uses, and shares information in connection with our website at sportsbug.com (the "Site") and our synchronized live audio streaming technology and related services (the "Service").

The Service is typically delivered inside applications operated by our team, league, school, and broadcaster partners, such as an official league or team app. When you use the Service inside a partner's app, that partner's own privacy policy governs the information the partner collects from you in its app. This Policy explains what information SportsBug receives and how we handle it. Where SportsBug processes personal data on behalf of a partner, we act as a service provider or processor under the partner's instructions.

By using the Site or the Service, you agree to the practices described in this Policy. If you do not agree, please do not use the Site or the Service.

2. Information We Collect

Information you provide to us

• Contact and business information. If you email us, request a demo, or discuss a partnership, we collect the information you choose to provide, such as your name, email address, phone number, employer, and title, and the contents of your correspondence.
• Recruiting information. If you inquire about working with us, we collect the information you submit, such as a resume or work history.

Information collected automatically

• Device and technical data. When you visit the Site or use the Service, we and our vendors may collect your IP address, device type, operating system, browser type, mobile network information, and similar technical identifiers.
• Usage data. We collect information about how the Site and the Service are used, such as pages viewed, referring pages, the date, time, and duration of listening sessions, stream start and stop events, buffering and delivery performance, and the venue or event associated with a stream.
• Approximate location. The Service may use IP address or information provided by a partner app to determine approximate location, for example to confirm that a listener is in or near a venue. SportsBug does not collect precise GPS location from your device. If a partner app collects precise location, that collection is governed by the partner's privacy policy and your device settings.
• Cookies and similar technologies. See Section 4 below.

Information we receive from partners

• Listening and engagement data. Our partners may share with us, or permit us to measure, aggregated or pseudonymous data about use of the Service in their apps, such as listener counts, session lengths, and engagement with sponsored audio content. This data typically does not directly identify you.

We do not knowingly collect government identification numbers, financial account credentials, health information, biometric data, or other categories of sensitive personal data through the Site or the Service, and we do not sell sensitive personal data or biometric data.

3. How We Use Information

We use the information described above to:

• Deliver, operate, synchronize, and maintain the Service, including measuring and improving audio delivery performance at venue scale;
• Respond to inquiries and manage business, partner, and vendor relationships;
• Measure audience engagement and produce analytics and reporting for our partners, principally in aggregated or de-identified form;
• Improve and develop the Site, the Service, and new features;
• Protect the security and integrity of the Site and the Service, including detecting and preventing fraud, unauthorized access, and abuse;
• Comply with legal obligations and enforce our agreements, including our Acceptable Use Policy; and
• Communicate with you about the Service, with your consent where required.

4. Cookies and Analytics

The Site uses cookies and similar technologies for basic functionality and analytics, such as understanding which pages are visited and how visitors reach the Site. We use these tools to measure and improve the Site, not to build advertising profiles of individual visitors.

You can control cookies through your browser settings, including blocking or deleting them. If your browser transmits a recognized universal opt-out signal, such as Global Privacy Control, we will honor it where required by applicable law. The Site does not currently respond to other "Do Not Track" signals, for which no industry standard exists.

5. How We Share Information

We do not sell your personal data, and we do not share your personal data with third parties for their own marketing purposes. We share information only in the following circumstances:

• Service providers. With vendors who perform services for us, such as cloud hosting, analytics, and communications, under agreements that restrict their use of the information to providing those services.
• Partners. With the team, league, school, or broadcaster partner whose broadcast you are listening to, principally in aggregated or de-identified form, for audience measurement, sponsorship reporting, and service operations.
• Legal and safety. When we believe disclosure is required by law, regulation, legal process, or a government request, or is necessary to protect the rights, property, or safety of SportsBug, our partners, our users, or the public.
• Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business, in which case we will require the recipient to honor this Policy or provide notice of a new one.
• With your direction or consent. When you ask us to share information or otherwise consent to sharing.

We may use and share aggregated or de-identified data that cannot reasonably be used to identify you, and we commit to maintaining such data in de-identified form and not attempting to re-identify it.

6. Your Privacy Rights: Texas Residents

If you are a Texas resident, the Texas Data Privacy and Security Act ("TDPSA") gives you the following rights with respect to personal data we control:

• Right to know and access. Confirm whether we process your personal data and access that data.
• Right to correct. Correct inaccuracies in your personal data.
• Right to delete. Request deletion of personal data provided by or obtained about you.
• Right to portability. Obtain a copy of personal data you provided to us in a portable and readily usable digital format, where technically feasible.
• Right to opt out. Opt out of the processing of your personal data for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. SportsBug does not currently sell personal data, serve targeted advertising based on your personal data, or engage in such profiling; if that changes, we will update this Policy and provide the required opt-out before doing so.
• Right to non-discrimination. Exercise your rights without discrimination or retaliation.

How to exercise your rights

Submit a request by emailing privacy@sportsbug.com with the subject line "Privacy Request," describing the right you wish to exercise. We may need to verify your identity using commercially reasonable efforts before acting on a request, and we may ask for additional information solely for that purpose. An authorized agent may submit an opt-out request on your behalf.

We will respond within 45 days of receiving your request. Where reasonably necessary, we may extend that period by an additional 45 days and will notify you of the extension and the reason for it. We will honor up to two requests per consumer free of charge in any 12-month period.

Appeals

If we decline to take action on your request, we will explain our justification in writing. You may appeal our decision by replying to our response, or by emailing privacy@sportsbug.com with the subject line "Privacy Request Appeal," within a reasonable period after receiving it. We will respond to your appeal in writing within 60 days, including an explanation of the reasons for our decision. If your appeal is denied, you may submit a complaint to the Texas Attorney General at consumerprotection.texasattorneygeneral.gov.

7. Your Privacy Rights: Other US States

Residents of other states with comprehensive privacy laws, including California, Colorado, Connecticut, Oregon, Virginia, and others, may have similar rights of access, correction, deletion, portability, and opt-out under those laws. We extend the request and appeal process described in Section 6 to residents of any state whose law provides comparable rights. To exercise them, use the contact information and process in Section 6. California residents: we do not sell or "share" personal information as those terms are defined in the California Consumer Privacy Act, and we have not done so in the preceding 12 months.

8. Children's Privacy

The Site and the Service are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete it. If you believe a child has provided us personal information, contact us at privacy@sportsbug.com. Where a partner's app is directed to general audiences that may include minors, the partner's privacy policy and parental controls govern collection in that app.

9. Data Security and Retention

We maintain administrative, technical, and physical safeguards designed to protect personal data against unauthorized access, disclosure, alteration, and destruction, appropriate to the volume and nature of the data we handle. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We retain personal data only as long as reasonably necessary for the purposes described in this Policy, to comply with legal obligations, to resolve disputes, and to enforce agreements. Aggregated and de-identified data may be retained indefinitely.

10. Third-Party Sites and Partner Apps

The Site links to third-party websites, and the Service operates inside partner apps that we do not control. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policy of any partner app or third-party site you use, including the app through which you access SportsBug audio.

11. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the "Last updated" date above, and for material changes we will provide additional notice on the Site or through the Service as required by applicable law. Your continued use of the Site or the Service after a change takes effect constitutes acceptance of the revised Policy.
